Terms of Service

1. Operator and contact

Nutmeg is an electronic service operated by Marcin Sobieraj, a sole trader registered in Poland, NIP 7831900655, Piaskowa 6 lok. 26, 61-753 Poznań, Poland. Contact: hello@usenutmeg.com.

2. Service and beta status

Nutmeg helps music teachers organise students, lessons, assignments, practice progress, communication, uploaded teaching media, calendars and lesson-payment records. Teacher accounts are offered only to teachers, teaching studios and similar users acting in connection with professional teaching activity. Students invited by a teacher remain permitted users and use only the features their teacher makes available. Parent access is not part of the current beta.

The beta is free. Nutmeg does not charge teachers a subscription. Stripe Connect functionality is sandbox-only and cannot process real-money payments. Material beta features may change, but Nutmeg will not remove mandatory rights.

3. Technical requirements and risks

Nutmeg requires a current web browser, internet connection, working email address and JavaScript/cookies or equivalent browser storage needed for authentication and requested functions. Google or supported media services are needed only for the optional features that use them.

Internet services can be interrupted and carry risks such as phishing, credential theft, malicious files and unauthorised access. Users must protect their email and device, use genuine Nutmeg links and report suspected compromise promptly. Nutmeg uses reasonable security measures but does not promise uninterrupted or error-free operation.

4. Teacher account and agreement

A new teacher requests an account through Google sign-in or a magic link. The contract begins when Nutmeg creates the teacher profile after the teacher actively agrees to these Terms, including the Data Processing Agreement where it applies, and acknowledges receipt of the Privacy Policy. A teacher whose beta account predates publication must make the same explicit acknowledgment before continuing to use the teacher workspace. That acknowledgment is not consent to optional analytics. In each case, Nutmeg records the actual submission time and the applicable Terms and Privacy Policy versions as evidence of the action; the DPA shares the accepted Terms version.

The teacher must supply accurate information, keep access secure and use one person's account only for that person. A person acting for a studio or another organisation confirms that they have authority to bind it. Although teacher accounts are intended for professional teaching activity, these Terms do not exclude any consumer or similar statutory protection that applicable law makes mandatory in a particular case.

5. Student records and invitations

Students cannot self-register. A teacher may create a limited non-login student record and may later issue an invitation. Before inviting, the teacher confirms that they have appropriate authority to create and use the student's information, issue the invitation and permit the student's use of Nutmeg.

Direct or login-enabled Nutmeg accounts are prohibited for anyone the teacher or Nutmeg knows to be under 13, regardless of country. The teacher must not invite such a person. Nutmeg does not require date of birth solely to enforce this rule, but an existing birthday showing an age below 13 blocks activation. If Nutmeg later learns that a login-enabled user is under 13, Nutmeg may disable access and review or delete the account/data.

A teacher may maintain a limited non-login record about an under-13 student only with appropriate authority and only to the extent needed for teaching. The teacher remains responsible for deciding what student information is necessary and for responding to the student or guardian where the teacher controls that information. Nutmeg does not create a guardian-consent workflow in this beta.

6. Acceptable use

Users must comply with law and must not:

• upload unlawful content or content they lack permission to use;
• harass, exploit or endanger another person or disclose unnecessary sensitive information;
• probe, bypass, overload or misuse security, authentication, rate limits or another account;
• introduce malware, scrape the service abusively or use it to send unsolicited messages; or
• misrepresent age, identity, authority, payment status or another material fact.

7. User content

The user or relevant rights holder keeps ownership of uploaded content. The user grants Nutmeg a limited, non-exclusive permission to host, copy, process, adapt technically, transmit and display that content only as needed to provide, secure, back up and support Nutmeg. This permission ends when the content is deleted, subject to shared records, legitimate retention decisions and provider backup cycles.

The uploading user confirms they may use the content and provide the necessary permission. Teachers should not upload copyrighted scores, recordings or personal information unless they have an appropriate right or lawful basis.

8. Third-party services

Optional Google, Stripe sandbox, bunny.net, YouTube and Vimeo functions depend on third-party services and may be governed by their own terms. Connecting Google Calendar authorises Nutmeg to access the selected data until disconnect/revocation. Teacher-added external links or embeds are the teacher's responsibility.

If live payments are enabled in the future, the parties will receive advance information and any required updated terms. This beta does not authorise real-money processing.

9. Availability, maintenance and changes

Nutmeg may maintain, secure, correct, replace or discontinue beta functions. Planned material changes will be communicated by email and/or in-app notice, as appropriate. Nutmeg may immediately address a security, legal or abuse risk. There is no service-level guarantee for the free beta.

10. Suspension and termination

Nutmeg may restrict or suspend access when reasonably needed to address unlawful content, a material breach, abuse, a security threat, false authority/age information, provider failure or a legal requirement. Where reasonable, Nutmeg will explain the reason and allow correction. Urgent risks may be handled without advance notice.

A user may stop using Nutmeg at any time and may request account deletion at hello@usenutmeg.com. Approved deletion requests are handled promptly, normally within 30 days. Shared data, disputes and records retained for a specific legal, security or claims purpose may require different treatment, which will be explained. Deleted data may remain temporarily in database backups, where configured, or in provider recovery systems, caches and logs until it is overwritten or deleted under each system's normal operating cycle. These systems differ by provider and configuration and are not used for ordinary product access.

11. Complaints

A complaint should identify the account, describe the issue and state the requested outcome, and be sent to hello@usenutmeg.com or the postal address in section 1. Nutmeg will acknowledge and answer without undue delay. These Terms do not limit rights to complain to a public authority or use mandatory consumer dispute remedies.

12. Responsibility

Each user is responsible for their own teaching decisions, content, communications and authority over student information. Nutmeg is not a music school, guardian, payment party or professional adviser. Nutmeg remains responsible where liability cannot legally be excluded. Nothing in these Terms limits mandatory consumer rights or liability for intentional misconduct, gross negligence, personal injury or another matter that law does not allow to be limited.

13. Privacy and data processing

The Privacy Policy explains Nutmeg's own processing. The current Data Processing Agreement available at /dpa is incorporated into these Terms by reference and automatically forms part of the agreement where the customer uses Nutmeg to process student, pupil or studio personal data as a controller and Nutmeg acts as processor. In that case, the customer/controller is the teacher accepting through the authenticated Nutmeg account or, where that person acts for a teaching organisation and has authority to bind it, that organisation as identified through the account and service relationship.

The DPA has the same version as these Terms and is available as a downloadable English and Polish copy before acceptance. It becomes effective for that customer at the genuine server-recorded time at which the teacher accepts these Terms, including when an existing teacher completes the first-publication acknowledgment. No separate checkbox or manual signature is required. The Cookie Policy explains browser storage and optional analytics.

14. Law, language and changes

Polish law governs these Terms, without depriving a consumer of mandatory protection provided by otherwise applicable law. Mandatory rules also determine the competent court. The reviewed Polish Terms are authoritative; the English version is supplied for accessibility and must express the same rules.

Version and effective date: 2026-09-13. Material changes will be communicated by email and/or in-app notice, as appropriate. Continued use will not be treated as acceptance where an active agreement is legally or contractually required; Nutmeg will request it separately.
